J U D G M E N T (oral)
¶1Petitioners herein seek quashing of FIR No. 418/2021 dated
31.07.2021, registered at P.S. Karol Bagh, for commission of offences under Sections 354/354A/509 IPC, along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties.
¶2The abovesaid FIR was registered on the basis of complaint lodged by respondent No.2 herein. She got married on 14.11.2017, as per Hindu rites and customs. One male child was born from the said wedlock. Her husband, however, fell seriously ill and, eventually, died in the year 2020.
¶3According to her, after the death of her husband, her brother-in-law i.e. petitioner No.1 used to come to her room and used to touch her inappropriately and misbehaved with her and even slapped her. She claimed that on one occasion, when she was away and came back, she saw that the lock of her room was broken open and her belongings were lying scattered. She also alleged that her sister-in-law (petitioner No.2) had pulled her hair and dragged her out of the house.
¶4Based on the abovesaid averments, the abovesaid FIR was registered in the year 2021.
¶5Charge-sheet has already been filed and charges have also been ascertained and the case is at the stage of Prosecution Evidence.
¶6Quashing is being sought for the reason that the matter has been amicably settled between the parties and they have been able to resolve all their disputes.
¶7Copy of Settlement Deed dated 28.11.2025 has also been placed on record.
¶8Respondent No.2 is present in Court and has been duly identified by her counsel as well as by Investigating Officer.
¶1When asked, respondent No. 2 submits that with the intervention of family friends and well-wishers, she has amicably settled the matter with the petitioners, out of her own free will, without any coercion and influence from any corner whatsoever. She submits that she is not interested in pursuing with FIR in question and as per settlement, she has already received the entire settlement amount of Rs.2,50,000/- and, therefore, she would have 'no objection' if FIR in question is quashed.
¶2Her affidavits to abovesaid effect have also been placed on record and reliance is placed on Gian Singh v. State of Punjab & Anr. (2012) 10 SCC
303.
¶9In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose. Reference be made to Narinder Singh & Ors. vs. State of Punjab & Anr., (2014) 6 SCC 466, wherein the Apex Court had observed that proceedings, even in non-compoundable cases, can be quashed on the basis of settlement provided
that the Court is satisfied that there was no meaningful purpose in continuing with the proceedings, and that the scope of conviction was remote and bleak.
¶10Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed appropriate to quash the instant FIR.
¶11Consequently, to secure the ends of justice, FIR No. 418/2021 dated
31.07.2021, registered at P.S. Karol Bagh, for commission of offences under Sections 354/354A/509 IPC, along with all consequential proceedings arising therefrom, is, hereby, quashed.
¶12Settlement Agreement dated 25.11.2025 and original affidavits, copies of which have been filed with the present petition, shall be submitted before the learned Trial Court within two weeks, so that these become part of the Trial Court Record.
¶13The petition stands disposed of in aforesaid terms.
¶14Pending application also stands disposed of.
