Hon'ble Rakesh Thapliyal, J.

Mr. Shashi Kant Shandilya, learned counsel for the applicants in C528 Nos.1507 of 2026 and 1410 of 2025.

¶2Mr. Himanshu Pal, learned counsel for the applicants in C528 Nos.1448 of 2026 and 1631 of 2025.

¶3Mr. Himanshu Sain, learned AGA, for the State of Uttarakhand.

¶4Ms. Nancy Singh, learned counsel for the respondent nos.2 and 3.

¶5All these petitions are preferred under Section 528 of BNSS, 2023, challenging the proceedings arising out of two first information reports lodged on

12.09.2023 at Police Station Raiwala, District Dehradun bearing FIR No.206 of 2023 and FIR No.207 of 2023, on the grounds that the parties have settled their dispute amicably and the entire amount has been returned back to the informant.

¶6The petition is supported with the compounding applications filed along with the affidavit of all the applicants and the respondent/informant and the victims. All the applicants are present in Court. The victim/informant joined the proceedings through VC and are duly identified by their counsels.

¶7It is contended in the compounding applications that primarily the allegations alleged in the FIR is civil in nature and furthermore now the parties have settled their dispute and the entire money has been paid to the informant as well as to the victim. It is argued that since the parties have settled their dispute, therefore, the proceedings be dropped.

¶8Learned counsel for the informant and the victim also submits that since now the parties have settled their dispute and received the entire money from the applicants, therefore, they do not want to pursue with the proceedings.

¶9On the other side, Mr. Himanshu Sain, learned AGA, submits that since the parties have settled their dispute amicably and the allegations are personal in nature and appears to be civil dispute and not against the society, therefore, in such an eventuality though some of the penal provisions are non compoundable but taking into consideration that the parties have settled their dispute amicably, the proceedings can be dropped. He further submits that even otherwise since now the parties have settled their dispute, there is no useful purpose to continue with the proceedings.

¶10After hearing the submissions of the learned counsel for the parties, and after considering the grounds as taken in the compounding applications and the submissions as advanced by the learned State Counsel, this Court is of the view that there is no useful purpose to continue with the proceedings of the Trial Court initiated on the basis of the two FIR(s) i.e. FIR No.206 of 2023 and FIR No.207 of 2023 and as such this Court is of the view that the compounding applications deserve to be allowed. Accordingly, all the petitions along with the compounding applications are allowed, and the impugned proceedings arising out of the aforesaid two FIRs i.e. Criminal Case No.189 of 2024 as well as Criminal Case No.188 of 2024, pending in the court of learned Judicial Magistrate, Rishikesh, District Dehradun, are hereby quashed.
