Being aggrieved by and dissatisfied with the judgment and award dated

17.08.2023 passed in connection with T.S.(MAC) 192 of 2019 by the learned Member, Motor Accident Claims Tribunal No.1, West Tripura, Agartala, the present appeal has been preferred by the appellant. [7]

After perusal of the record, it appears to this court that the deceased used to earn Rs.57,701/- per month as he was an Ex. Pump Operator. Thus, considering Rs.57,701/- as the monthly income of the deceased, the compensation of Rs.59,72,700/- (Rupees Fifty nine Lakh Seventy two Thousand Seven Hundred only) was awarded by the Ld. Tribunal. A bare reading of the record shows that the learned tribunal has taken into consideration all aspects with regard to compensating the claimants. But the claimant-appellants are before this court for enhancing the quantum of compensation awarded by the Ld. Tribunal that cannot be granted at this juncture and this court is of the view that this appeal may be dismissed. [8]

In view of the overall analysis made by the learned tribunal below and after going through the material evidence in its entirety, this Court is of the view that the assessment of compensation as awarded by the learned tribunal below is just and proper and needs no interference thus, the findings as arrived by the learned tribunal below stands affirmed.
