Thounaojam Santoshchandra Luwang & 8 Ors … Petitioners -Versus-State of Manipur & 3 Ors … Respondents

BEFORE HON'BLE MR. JUSTICE A.GUNESHWAR SHARMA

16.04.2024

Mr.N.Ibotombi, learned senior counsel assisted by Ms.N.Savitri, learned counsel for the petitioners, Ms.Ch.Sundari, learned Government Advocate for respondent Nos.1 and 2 and Mr.Jasobanta, learned counsel for respondent No.3.

It is the case of the petitioner that they are working in the MANITRON in different capacity and they have submitted separate representations dated 2.11.2023 to the respondent No.3 as well as to the State Government for consideration of implementation of 6th and 7th Pay Commission recommendation with respect to the employees of MANITRON. It is pointed out that vide Office Memoranda dated 28.2.2011 and 2.8.2022, the State Government issued Notification for implementation of 6th and the 7th Pay Commission recommendation for the employees of the State Government including those of Autonomous Body, Local Aid Bodies, Grant in aid Body and Public Sector Undertaking etc. It is also pointed out that the MANITRON is a Public Sector Undertaking under the Government of Manipur and is covered by the above Office Memoranda.

By the present writ petition, a direction is prayed for issuing necessary Notification for implementation of the recommendations of the 6th and 7th Pay Commission recommendation in respect to the employees of the MANITRON.

Ms.Ch.Sundari, learned Government Advocate referring to para 4 of the counter affidavit has pointed out that the MANITRON has not submitted necessary proposal for implantation of grant of benefit of Manipur Service Revised Pay in terms of ROP 2010 and 2019.

Mr.S.Jasobanta, learned counsel for the MANITRON has pointed out that vide letter dated 27.09.2019, the Managing Director, MANITRON had already submitted proposal with respect to the implementation of 6th Pay Commission in MANITRON and due to poor financial condition of the MANITRON it would be difficult to implement the recommendation of the 6th and 7th Pay Commission.

Mr.N.Ibotombi, learned senior counsel for the petitioners has pointed out that the writ petition may be disposed of by issuing a direction to the MANITRON to submit proposal for implementation of the 6th and 7th Pay Commission recommendation for the employees of MANITRON and to make clarification to the queries made by the State Government with respect to recommendation of the 6th Pay Commission.

Learned counsel for the respondents have no objection to the submission made by Mr.N.Ibotombi, learned senior counsel for the petitioners.

Recording the submissions at the Bar and on perusal of materials on record, this writ petition is disposed of with the direction to the MANITRON to submit proposal for implementation of the 6th and 7th Pay Commission Recommendation for the employees of MANITRON and to submit clarification to the queries made by the State Government with respect to the pending and new proposals within a stipulated period of two months from receipt of copy of this order. Upon receipt of the proposal from the MANITRON along with clarification, the State Government has to complete the process for issuing necessary recommendation in terms of the O.Ms dated 28.2.2011, 2.8.2022 within a further period of three months from the date of receipt of recommendation from the MANITRON.

With these observations, the writ petition is disposed of.
