Order

23.05.2024 [1]

Heard Mr. I. Lalitkumar, learned senior counsel assisted by Ms. N. Deepika, learned counsel for the petitioner and Mr. Shyam Sharma, learned G.A. for the State respondent. [2]

The petitioner, who is working as Video Editor in Directorate of Information and Public Relation on regular basis, approached this Court, inter-alia, praying for a direction to the proposed DPC to follow the relevant Recruitment Rules for the post of Producer (Audio/Visual). [3]

Learned senor counsel for the petitioner draws the attention of this Court to the Recruitment Rules for the post of Producer (Audio/Visual) as per MPSC Form – 8 at column No. 5, the post is selection and as per column No. 11, it is a promotion from the post of Page 2

Cameraman/Movie Cameraman/Photo Technician/Video Editor/Sr. Cameraman who rendered a minimum of 5 years regular service in the respective grade and possessing experience certificate course in Film /Video production and at least 10+2 certificate from a recognized University or its equivalent. [4]

The DIPR has proposed for appointment of promotion of one post of Producer (Audio/Visual) and in this regard, the Under Secretary, Manipur Public Service Commission wrote a letter dated

15.04.2024 to the Deputy Secretary (IPR), Government of Manipur to clarify whether the Film/Video production certificate as mentioned in the RR should be from a recognized University or not. In its reply dated

22.04.2024, the Deputy Secretary (IPR), Government of Manipur informed the Under Secretary, MPSC that the Experience/Certificate course in Film /Video production mentioned in the RR should be from a recognized University. [5]

Thereafter, on enquiry by the Department of IPR from the Principal, Film Institute, Manipur in its reply dated 02.08.2022, the Principal of Film Institute, Manipur clarified that the institute is not affiliated to any University or Board as of now. [6]

Mr. I. Lalitkumar, learned senior counsel for the petitioner, submits that many of the aspirants for the post are submitting the certificate issued by the Film Institute, Manipur. However, these certificates are not admissible as per RR and prayed Page 3

that the certificates issued by the Film Institute, Manipur shall not be considered by the DPC for consideration of promotion. [7]

Mr. Shyam Sharma, learned G.A. for the State respondent, submits that the writ petition is pre-matured and it is filed on mere apprehension that the certificates from Film Institute will be considered. [8]

This Court has considered the submissions made at the bar, the materials on record and is of the opinion that the writ petition can be disposed of at this stage by passing an observation that the DPC may consider the relevant Rules and the petitioner is at liberty to approach, if aggrieved, by any decision of the DPC. [9]

With this observation, writ petition is disposed of without expressing any opinion on the merit of the case. Misc. application is also disposed of accordingly. [10]

A copy may be furnished to the learned counsel appearing for all the parties.
