Judgment
IN THE HIGH COURT OF MANIPUR AT IMPHAL MC(WP(C)) No. 275 of 2024 Sarangthem Mani Chenglei
… Applicant/s Vs. State of Manipur & 2 ors.
… Respondent/s
B E F O R E HON'BLE MR. JUSTICE AHANTHEM BIMOL SINGH 06-05-2024 Heard Mr. S. Rupachandra, learned senior counsel assisted by Md. Sahidur Rahaman, learned counsel appearing for the applicant and Mr. Niranjan Sanasam, learned GA appearing for the respondents. [2]
The present application has been filed with a prayer for making certain modification in the order dated 02-02-2024 passed by this Court in W.P.(C) No. 85 of 2024. By the said order dated 02-02-2024, this Court has disposed of the said writ petition by directing the Director Settlement and Land Records, Government of Manipur to consider the representation dated 11-09-2023 submitted by the petitioner and to dispose of the same by issuing a speaking order within a period of 2(two) months. The said direction has been given by this Court on the basis of the submission made by the learned senior counsel appearing for the writ petitioner/applicant. [3]
It has been submitted by Mr. S. Rupachandra, learned senior counsel that the said representation was addressed to (i) The Commissioner (Revenue), Government of Manipur (ii) The Director, Settlement & Land Records, Government of Manipur and (iii) The Deputy Supl. IN. 3 Commissioner, Imphal West District, Lamphelpat, Government of Manipur. [4]
The learned senior counsel further submitted that due to inadvertent mistake, it had been submitted before this Court that the representation should be considered by the Director of Settlement and Land Records, however, when the order of this Court was communicated to the said Director of Settlement & Land Records, the Director of Settlement & land Records issued an order dated 08-02-2024 stating, inter alia that the office of the Director of Settlement & Land Records has no jurisdiction in respect of correction of the classification of land as appeared in the land records and that the said correction should be made by the Deputy Commissioner, Imphal West. [5]
In view of the above, the learned senior counsel appearing for the petitioner submitted that the earlier order dated 02-02-2024 passed by this Court in WP(C) No. 85 of 2024 be modified by directing the Deputy Commissioner, Imphal West to consider the said representation on its own merit and strictly in terms of the applicable act and rules and to dispose of the same by issuing a speaking order within a period of 2(two) months from today. [6]
Mr. Niranjan Sanasam, learned GA appearing for the respondents fairly submitted that he has no objection in allowing the present application. [7]
In view of the submission made by the learned counsel appearing for the parties and on perusal of the records, this Court finds sufficient grounds for allowing the present application. [8]
Accordingly, the Deputy Commissioner, Imphal West is hereby directed to consider the said representation dated 11-09-2023 submitted by the petitioner on its own merit and strictly in terms of the applicable act and rules and to dispose of the same by issuing a speaking order within a period of 2(two) months from the date of receipt of a certified copy of this order. [9]
With the aforesaid directions, the present application is disposed of.
