The petitioners in WP(C)No.199 of 2024 have approached this Court seeking direction to the Dhanamanjuri University for declaring the result of the recruitment of Assistant Professors in Zoology subject. [3]

Mr. RK Deepak, learned senior counsel draws the attention of this Court to an order dated 02.08.2024 passed by this Court in WP(C)No.790 of 2023 wherein on joint submission of the parties, this Court directed Dhanamanjuri University to declare the result of the recruitment of Assistant Professors. [4]

During the course of hearing, it is pointed out that there is an interim order dated 13.12.2021 passed in WP(C)No.833 of 2021 wherein there was a stay of declaration of the result of the Assistant Professors of Zoology without the leave of this Court. [5]

Mr. I. Lalitkumar, learned senior counsel for Dhanamanjuri University submits that the result for Zoology subject could not be declared due to the direction given in the interim order dated

13.12.2021. [6]

Mr. N. Jotendro, learned senior counsel for the petitioner in WP(C)No.833 of 2021 submits that the writ petition may be disposed of with a direction to the respondent University to intimate to the

petitioner who also applied for Assistant Professor in Zoology subject about his detail marks obtained in the examination. [7]

Mr. I. Lalitkumar, learned senior counsel appearing for Dhanamanjuri University draws the attention of this Court to Annexure A/2 at page 32 and para 15 of the writ petition in WP(C)No.833 of 2021. It is stated that the petitioner name is included in the list of ineligible candidates for the post of Assistant Professors in Zoology subject for the said University and one post may be kept reserved till the disposal of the present writ petition in WP(C)No.833 of 2021. [8]

Mr. Th. Sukumar, learned GA for the State respondents submits that at the moment the State Government has no role in the matter. [9]

In the advertisement dated 19.12.2020, 4(four) posts of Assistant Professor, Zoology (3 UR,1 ST) were advertised along with other subjects and in order to facilitate declaration of the result of the Zoology subject and considering the nature of relief prayed for in the writ petition in WP(C)No.833 of 2021, this Court is modifying the interim order dated 13.12.2021 passed by this Court in WP(C)No.833 of 2021 to the extent that the Dhanamanjuri University is permitted to declare the result for Zoology subject and may fill up 2(two) posts of UR category and 1(one) post of ST category out of 4(four) posts advertised vide notification dated 19.12.2020 and it is clarified that 1(one) UR seat

shall be kept reserved till the disposal of the writ petition being WP(C)No.833 of 2021. [10]

With the above observations, the interim order dated

13.12.2021 passed in WP(C)No.833 of 2021 is accordingly modified and the writ petition being WP(C)No.199 of 2024 is disposed of in terms of the above directions. [11]

Misc. case being MC(WP(C))No.127 of 2022 is also accordingly closed. [12]

Furnish a copy of this order to the learned counsel appearing for the parties. [12]

List WP(C)No.833 of 2021 along with the connected matter filed by the same petitioner being WP(C)No.284 of 2022 on

30.04.2024 the date already fixed.
