Heard Mr.N.Kumarjit, learned senior counsel assisted by Mr.N.Zequeson, learned counsel for the applicant and Mr.David Boon, learned counsel for all the respondents.
MC (RSA) No.5 of 2024:
By the present application under Order XXII Rule 2 (1) CPC, the applicant is praying for bringing on record the Legal Heirs of the deceased appellant No.2 in RSA No.12 of 2016.
It is stated that the appellant No.2 expired on
8.12.2023 leaving behind seven legal heirs as mentioned in para-3 of the application and it is prayed that the application be allowed and the seven legal heirs of deceased appellant No.2 be impleaded as LRs of deceased appellant No.2.
Accordingly, the MC (RSA) No.5 of 2024 is allowed and legal heirs of the deceased appellant No.2 be brought on record in RSA No.12 of 2016.
The applicant is directed to make necessary incorporation in the Memo of Appeal of RSA No.12 of 2016.
With the observation, the application is disposed of.
MC (RSA) No.6 of 2024: Ref MC (RSA) No.17 of 2023: RSA No.12 of 2016
By the present application under Order VI Rule 17 CPC, the applicants are praying for bringing on record LRs of deceased appellant No.2 of the petition in M.C (RSA) No.17 of 2023 : Ref RSA No.12 of 2016.
It is stated in para 4 of the application that there will be no prejudice if the amendment is allowed.
Accordingly, the MC (RSA) No.6 of 2024 is allowed and legal heirs of the deceased appellant No.2 be brought on record in MC (RSA) No.17 of 2023 [Ref:RSA No.12 of 2016].
With the observation, the application is disposed of.
MC (RSA) No.7 of 2024
By the present application under Order XXII Rule 2(1) CPC, the applicant is praying for bringing on record the Legal Heirs of the deceased appellant No.2 in RSA No.12 of 2016.
It is stated that the appellant No.2 expired on
