Respondents BEFORE HON'BLE THE CHIEF JUSTICE MR. M. SUNDAR (ORDER)

30.03.2026 [1] Captioned 'Miscellaneous Case' ('MC') has been filed with a prayer seeking exemption from filing certified copy of the order that is assailed. To be noted, the order that is assailed is 'an order dated 15.12.2025 made in Original Suit No. 52 of 2023 on the file of the Court of Civil Judge (Junior) Division, Imphal East' ('impugned order' for the sake of brevity and convenience). [2] When the matter was taken up, revision petitioner No. 3, Mr. Aribam Phulchand Sharma, who is MC applicant No. 3 is before this Court as party-in-person. To be noted, MC applicant No. 3 is also a Member of the Bar (Advocate) but is representing party-in-person in this case. [3] Mr. L.N. Ngamba, learned counsel who is in Court submits that he would be representing the other MC applicants, namely, MC applicant Nos. 1, 2 & 4 to 7. LAIREN MAYUM INDRAJE ET SINGH by LAIRENMAYUM INDRAJEET SINGH Date: 2026.03.31 +05'30' [4] When the matter was taken up, afore-referred party-in-person and afore-referred learned counsel were faced with the following difficulties:

¶1Learned counsel Mr. L.N. Ngamba has filed Vakalatnama in the main Civil Revision Petition (CRP) and not in the captioned MC. To be noted, main CRP has not yet come into existence as the same will be numbered (if at all that be so) only if captioned MC is allowed.

¶2In the captioned MC, other than saying that certified copy of impugned order has not been applied for and obtained, no reason for seeking exemption has been mentioned.

¶3Copy of the plaint in Original Suit No. 52 of 2023 has not been filed. What has been filed is only an extract copy of the impugned order. [5] Faced with the above situation, MC applicant No. 3 and Mr. L.N. Ngamba, learned counsel made an endorsement in the case file seeking leave of this Court to withdraw the captioned MC. However, party-in-person and learned counsel made a request to preserve all the rights and contentions of the MC applicants to come back to this Court after making necessary course corrections. A scanned reproduction of the endorsement is as follows: [6] Afore-referred request of party-in-person and learned counsel is acceded to but subject to the condition that if a fresh MC is filed, instant order should also be filed along with the MC. [7] In the light of the narrative thus far, captioned MC is disposed of as withdrawn/closed albeit with preservation of rights as mentioned supra and subject to the condition set out supra. There shall be no order as to costs. CHIEF JUSTICE Indrajeet P.S. I : Upload forthwith. P.S.
