IN THE HIGH COURT OF MANIPUR AT IMPHAL WP(C) No. 1 of 2024 Soibam Indrakumar
… Petitioner Vs. State of Manipur & ors.
… Respondents B E F O R E HON'BLE MR. JUSTICE AHANTHEM BIMOL SINGH 11-01-2024
Heard Mr. N. Jotendro, learned senior counsel assisted by Md. Abdul Baqee Khan, learned counsel appearing for the petitioner; Mr. S. Nepolean, learned GA assisted by Mrs. R.K. Emily, learned Deputy GA appearing for the respondents No. 1 to 4 and Mr. N. Ibotombi, learned senior counsel assisted by Ms. Babina, learned counsel appearing for the respondent No. 5.
In view of the limited prayer made on behalf of the petitioner and as agreed to by all the counsel appearing for the parties, the present writ petition is disposed of at the Motion stage itself.
At the outset, Mr. N. Jotendro, learned senior counsel appearing for the petitioner submitted that the petitioner will be satisfied for the time being if the present writ petition is disposed of by directing the Registrar of Societies, Manipur to consider the representation dated 26-12-2023 and 29-12-2023 submitted by him to the Registrar of Societies, Manipur on its own merit and in terms of the applicable act and rules and to dispose of the same by issuing a speaking order within a stipulated period.
Mr. S. Nepolean, learned GA submitted that he has received instruction from the Registrar of Societies, Manipur that the said representations are still pending for consideration and disposal and that as the prayer made on behalf of the petitioner is confined to the consideration and disposal of the writ petition, he has no objection in disposing of the representations as prayed for on behalf of the petitioner. On the other hand, Mr. N. Ibotombi, learned senior counsel appearing for the respondent No. 5 submitted that at earlier point of time, the petitioner has submitted various representations to the Registrar of Societies, Manipur and the Registrar of Societies, Manipur has already considered and disposed of IN. 5 SHOUGRA KPAM DEVANAN DA SINGH Date: 2024.01.12 07:34:18 +05'30' WP(C) No. 1 of 2024 Contd…/-
such representations. The learned senior counsel further submitted that pursuant to the order passed by this court and the order passed by the Registrar of Societies, Manipur, the respondent No. 5 has already issued a Notification dated 23-12-2023 for holding an Annual General Meeting of the Manipur Olympic Association on 14-01-2024 for consideration of the agendas mentioned in the said Meeting Notice, including election of new office bearers of the said association. The learned senior counsel further submitted that since the meeting is going to be held as desired by the writ petitioner and in terms of the order passed by the Registrar of Societies, Manipur and this court, any direction to the Registrar of Societies, Manipur to consider the fresh representations submitted by the petitioner at this stage will create confusions and complicacies. The senior counsel also submitted that if such representations are to be considered by the Registrar of Societies, Manipur pursuant to the direction given by this court, the respondent No. 5 or any office bearer of the Association may be given an opportunity of being heard at the time of consideration of such representations by allowing them to file their objection to the said representations.
In view of the submissions advanced by the learned counsel appearing for the parties, the present writ petition is disposed of by directing the Registrar of Societies, Manipur to consider the said representations strictly on its own merit and in terms of the applicable act/ rules/ bye-laws and to dispose of the same by issuing a speaking order within a period of one month from today. It is also made clear that at the time of consideration and disposal of the said representations, the Registrar of Societies, Manipur should offer reasonable opportunity of being heard to the respondent No. 5 or any of its representatives by allowing them to file their written objection to the said representations.
With the aforesaid directions, the present writ petition is disposed of.
