ORDER The petitioner is before this Court to forbear the respondents from ejecting High Tension Transmission Tower and draw Transmission Line in Survey Nos.26/4B1D, 26/4B1C, 26/4B2B, 26/4B1E, 26/4C1B, 26/4B2D, 26/4C2A, 26/4C1A, 26/2B2, 26/3B, 26/2B1A1A, and 26/3A1A1, admeasuring a total extent of 4.15 acres situated at Mallampatti Village, Thirumangalam Circle, Thirumangalam Taluk, Madurai South.

¶2The petitioner claims to be the owner of the said land which are patta lands and the respondents 2 to 5, without following due process of law, are illegally trying to attempt to put up High Tension Transmission Towers and draw draw Transmission Lines.

¶3Mr.S.Deenadhayalan,learned Standing counsel appearing for R2 and R5 submitted that steps will be taken to erect transmission towers and draw transmission lines in the said land after obtaining permission from the first respondent under Section 16 of the the Indian Telegraph Act, 1885.

¶4The said submission is taken on record.

¶5Accordingly, the writ petition is disposed of directing the respondents 2 to 5 not to erect High Tension Transmission towers and draw Transmission lines in the petitioner's patta lands till a permission is obtained from the first respondent under Section 16 of the Indian Telegraph Act, 1885.

¶6There shall no orders as to Costs. Consequently, connected miscellaneous petition is closed.
