Judgment

ORDER Heard the learned counsel for the petitioner and the learned Special Government Pleader for R1 to R6. Issuance of notice to R7 is dispensed with.

¶2The petitioner is a resident of Poovalaikudi village in Ponnamaravathy Taluk. He alleges that in the petition mentioned survey numbers, the 7th respondent is erecting solar panels. Copy of the "A" register of Arasamalai village has been enclosed. It is seen therefrom that S.Nos.430 & 388 have been classified as water bodies.

¶3We direct the fourth respondent to conduct survey in this regard. Notices will be issued to the concerned temples as well as 7th respondent. If the fourth respondent comes to the conclusion after due enquiry and after giving opportunity to the 7th respondent that on the water bodies, the solar panels are being erected, action will be immediately taken to have the same removed. In other words, the original position and the water bodies will be restored. This exercise shall be completed within a period of two months from the date of receipt of a copy of this order.

¶4The writ petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
