Judgment

ORDER This writ petition has been filed seeking for issuance of a Mandamus, to direct the first respondent to dispose of the petitioner's representation dated

03.06.2025 and to de-freeze the petitioner's account bearing Account No.10082191084, held by the 1st respondent.

¶2The petitioner is holding an account with the first respondent bearing Account No.10082191084. While being so, the petitioner was arrested and remanded to judicial custody pursuant to the FIR, final report was filed and the same was taken cognizance in C.C No.519 of 2025 on the file of the II Additional NDPS Court, Chennai. The petitioner was found with 3.40 grams cocaine. During investigation, it was found that the entire crime proceeds were deposited in the account bearing No.10082191084 held in IDFC FIRST Bank Limited, Purasawalkam Branch, Chennai and, as such, on instructions of the 4th respondent, the first respondent has frozen the petitioner's account.

3.On instructions, the learned Government Advocate(Crl.Side) appearing Page3 of 5 for the respondents 2 to 4 would submit that after completion of investigation, final report was filed and the same was taken cognizance in C.C No.519 of 2025 on the file of the II Additional NDPS Court, Chennai, however, it is revealed that no amount has been seized from the said account and no material is also produced before the trial Court.

¶4Therefore, no purpose would be served in keeping the Bank account without permitting the petitioner to operate by freezing.

5.In view of the above, the first respondent is directed to de-freeze the petitioner's Bank account bearing No.10082191084 held in IDFC FIRST Bank Limited, Purasawalkam Branch, Chennai and permit the petitioner to operate the said account.
