¶2The case of the prosecution is that the petitioner is alleged to have abused the defacto complainant with filthy language and also attempted to murder the defacto complainant. Hence the case.

¶3The learned counsel appearing for the petitioner submitted that the main case in PRC.No.16 of 2022 is pending on the file of the learned District Munsif-cum-Judicial Magistrate, Kilvelur. He further submitted that the petitioner was regularly appearing before the trial court for all the hearing dates. But the petitioner was remanded in another case in Cr.No.285 of 2024 by the Inspector of Police, Velankanni Police Station, Velankanni, following the same, a preventive detention order was passed against the petitioner on 30.11.2024, due to which, the petitioner was unable to appear before the trial court on

28.01.2025. Consequently, an order of NBW was issued against the petitioner. On execution of NBW, the petitioner was arrested on 09.04.2026 and still he is in judicial custody. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in the present case and that he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the Petitioner.

¶4Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and Page3 of 7 submitted that it is a case of jumped bail. The PRC.No.16 of 2022 is pending on the file of the learned District Munsif-cum-Judicial Magistrate, Kilvelur. For the non-appearance of the petitioner, he was issued NBW on 28.01.2025 and the same was executed on 09.04.2025. Hence, he opposed for the grant of bail to the petitioner.

¶5Heard the learned counsel appearing for the petitioner, the learned Government Advocate (Crl.Side) for the respondent Police and perused the materials available on record.

¶6Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side) and considering the reasons stated in the petition for the non-appearance of the petitioner before the trial court, this Court is of the view that further custody for the purpose of investigation is not required. Hence, this Court is inclined to grant bail to the petitioner on certain conditions.

¶7Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum to the satisfaction of the learned District Munsif-cum-Judicial Magistrate, Kilvelur, and on further conditions that: Page4 of 7 [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019'].
