Judgment
ORDER Heard Mr.A.Bharathy Krishnan for the petitioners and Mr.S.Yogaraja Sekar, Government Advocate (Crl.Side) for the respondents.
2.The 1st petitioner is running a restaurant under the name and style of "Black Orchid". The 2nd petitioner is having a valid FL-2 license issued by the Commissioner of Prohibition and Excise under the provisions of the Tamil Nadu Liquor (License and Permit) Rules, 1981. Both the businesses are being carried on at No.105, Chamiers Road, Raja Annamalaipuram, Chennai – 600 028. The petitioners state that the licensed permit room is on the first floor and it is being operated only during the hours permitted under the license. Insofar as the ground floor is concerned, the 1st petitioner is running a restaurant.
3.The cause of action for the writ petition is that though the petitioners are complying with the license granted to them, the 3rd respondent is calling upon the restaurant too, to be closed at 11.00 PM when there is no such law in place.
4.When the matter came up for admission, I called upon Mr.S.Yogaraja Sekar, Government Advocate (Crl.Side) to file a counter. He has filed a counter.
5.The counter states that the respondent police are not monitoring the restaurant on a day-to-day basis. The counter further states that whatever actions they have taken are strictly in accordance with law and in due discharge of the statutory duties. The Inspector of Police, E4 Abiramapuram Police Station states that they will take action only in the event of any violation of the statutory licensed conditions, permitted hours or other requirements. The statement made by the police officer in paragraph No.7 of the counter affidavit is recorded.
6.There shall be a direction to the police not to interfere with the business of the petitioners while they are operating within the permitted limits of license. In the event of any violation, the police are free to take action.
7.In the result, this Writ Petition is ordered accordingly. No costs. 19-08-2026 krk Index:Yes/No Speaking/Non-speaking order Internet:Yes
