ORDER This Civil Revision Petition has been filed under Article 227 of the Constitution of India challenging the fair and decreetal order dated 08.04.2026 passed in I.A.No.11 of 2026 in O.S.No.473 of 2019 by the Learned Judge at III Additional District and Sessison Court Tiruvallur at Poonamallee, wherein the application filed by the petitioners/defendants to direct the Registrar of City Civil Court to grant certified copies of certain documents, came to be rejected by the Court below.
.Heard the learned counsel for the petitioners and the learned counsel appearing on behalf of respondent and carefully perused the materials available on record and this Court also carefully went through the order passed by the Court below.
.The respondent is the plaintiff in the suit filed in O.S.No.473 of 2019, seeking for the relief of declaration, possession and for damages. The suit was at the stage of trial. IA No.11 of 2026 came to be filed by the defendants seeking for the certified copy of certain documents on the ground that those documents were claimed by the plaintiff to be the source of title and therefore, those documents are necessary for effectively taking a final decision in the suit.
.In the considered view of this Court, the plaintiff is relying upon the decree passed in Partition Suit filed in O.S.No.854 of 1960, since he has purchased the property from the decree holder. Hence, if these documents are called for by the Court below, it will also help the plaintiff in establishing the case. The documents that are sought to be relied upon are the plaint filed in O.S.No.854 of 1960, a preliminary decree passed in O.S.No.854 of 1960 and the final decree passed in the said suit. The case is now pending before the III Additional District and Sessions Court, Tiruvallur. These documents are purportedly available before the City Civil Court, Chennai. In view of the same, the III Additional District and Sessions Court, Tiruvallur, shall call for the original records of O.S.No.854 of 1960 from the Registrar of the City Civil Court, Chennai. On such request being made, subject to the availability of those documents, the original record shall be sent to the III Additional District and Sessions Court, Tiruvallur, immediately. On receipt of the same, the Trial Court shall proceed further with the case. In any event, the suit in O.S.No.473 of 2019 shall be disposed of, within a period of four months from the next date of hearing. It is left open to both sides to raise all the grounds before the Court below and this Court has not rendered any findings on the merits of the case.
.In the result, this Civil Revision Petition is disposed of in the above terms. No Costs. Consequently, the connected miscellaneous petition is closed. 19-08-2026 Index:Yes/No Speaking/Non-speaking order Internet:Yes ssr To The III Additional District and Sessions Court Tiruvallur at Poonamallee.
