Judgment

ORDER The petitioner apprehends arrest for the alleged offence under Sections 354, 420, 406, 506(i) of IPC @ 376 of IPC, in Crime No.21 of 2026, on the file of the respondent police seeks anticipatory bail. Page2 of 4

2.The case of the prosecution is that on 04.11.2025 at about 11:00 a.m., when the defacto complainant visited her mother's house at Kullanoor, the first accused (A1) arrived there, introducing himself as a friend of her brother. It is alleged that the first accused had surreptitiously recorded a video of the defacto complainant while she was bathing. He subsequently began blackmailing her with the said video and committed rape upon her on several occasions. Further, on 27.02.2026, when the defacto complainant and her family members visited Yercaud, the first accused (A1) and the second accused (A2)/the petitioner herein allegedly spiked her soft drink with a sedative and committed rape upon her. It is further alleged that the accused continuously threatened her, causing severe mental depression by threatening to circulate the video online, and extorted money and jewellery from her. To date, they have allegedly extorted Rs. 13,00,000/- and 17 sovereigns of gold jewellery. Hence, the case.

3.The learned counsel for the petitioner submits that the petitioner is innocent, has not committed any offence, and has been falsely implicated in this case. Therefore, he prays for the grant of anticipatory bail to the petitioner.

¶4The learned Government Advocate (Criminal Side) appearing for the respondent police strongly opposes the grant of anticipatory bail. He submits that the petitioner systematically blackmailed and cheated the defacto complainant by threatening to leak her private video online. He further submits Page3 of 4 that the gravity of the offense is substantiated by the victim's statement recorded under Section 183 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.

5.Considering the heinous nature and seriousness of the allegations against the petitioner, involving blackmail, extortion, and the grave offense of rape, this Court is not inclined to grant anticipatory bail to the petitioner.

6.Accordingly, this Criminal Original Petition stands dismissed. 15-07-2026 GBI To
