Judgment

ORDER The petitioners apprehends arrest for the alleged offence under Sections 4 A(1)(a) of TNOPPD Act, in Crime No.36 of 2026 on the file of the respondent police seeks anticipatory bail.

2.It is case of the prosecution that the petitioner and others accused persons, without obtaining permission from the competent authority, placed Page2 of 4 banners on road side and caused disturbance of public. Hence the case.

¶3The learned counsel for the petitioner submits that the petitioner is no way connected to this case and has been falsely implicated in this case and he has not committed any offences as alleged by the prosecution. Hence, he prays to grant bail to the petitioner.

¶4The learned Government Advocate (Crl.Side) appearing for the respondent police submits that the petitioner has fourteen (14) previous cases of similar nature pending against him. He further submits that if the petitioner is enlarged on anticipatory bail, he may abscond and commit similar offences in future as well. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

¶5I have given my anxious consideration to the submissions made by the learned counsel on either side and also perused the records available.

6.From the submission made by the learned Government Advocate (Criminal Side), it is seen that the petitioner is involved in as many as 14 previous criminal cases. The existence of such a large number of criminal antecedents indicates that the petitioner is a habitual offender and has repeatedly come under the adverse notice of the law enforcement authorities. The criminal Page3 of 4 antecedents of the petitioner cannot be ignored while considering the relief of anticipatory bail.

¶7Having regard to the petitioner's antecedents, this Court is of the considered view that, if he is enlarged on anticipatory bail, there is every likelihood of his indulging in similar offences, interfering with the investigation. Hence, taking into consideration of interest of the society at large, this Court is not inclined to enlarge the petitioner on bail.

8.Accordingly, this criminal original petition stands dismissed. 15-07-2026 jrs Page4 of 4
