G.Revathi v. S.Sathurappan

ORDER This application has been filed seeking interim direction directing the 1 st respondent / 1 st defendant to produce all original documents of the properties purchased by the father of the applicant / plaintiff. But however, the list of such documents which are to be produced have not been mentioned in the annexure to the Judges Summons.

2.It is the contention raised that the 1 st defendant being the son of the family was in a position to secure the title documents of the properties of the father and therefore, by this application, the applicant seeks a direction for the st defendant to produce the original.

3.It would be helpful if the list of documents had been given as the 1 st defendant cannot go around searching and assume the nature of documents required by the applicant. Even otherwise, it would only be prudent that a notice to produce documents is first issued to the 1 st defendant and thereafter, the matter is taken up through its logical conclusion.
