18.06.2026 for the alleged offence under Sections 408, 420 r/w 120(b) of IPC in Crime No.9 of 2025 on the file of the respondent police, seeks bail. Page2 of 6
¶2The case of the prosecution is that defacto complainant is a Zonal Manager of Vistaar Finance Private Limited where the petitioner and other accused were working as Customer Relationship Manager. It is alleged that during the internal audit in the year 2024, it is found that the petitioner along with other accused misappropriated the fund thereby, the company met with a loss to the tune of Rs.44.13 lakhs. Hence, the case.
¶3The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in the present case and that he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the Petitioner.
¶4Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and submitted that the petitioner has been incarcerated since 18.06.2026. Hence, he opposed for grant of bail to the Petitioner. Page3 of 6
¶5I have given my anxious consideration to either side submissions and perused the materials available on record.
¶6Considering the facts and circumstances of the case; taking note of the submission made on either sides, the allegation against the petitioner is that the petitioner, who is in the capacity of Customer Relationship Manager, cheated the defacto complainant company to the tune of Rs.44 lakhs. Though there is serious allegation against this petitioner, he has been incarcerated since
18.06.2026. Considering the period of incarceration of the petitioner since
18.06.2026, this Court is of the firm view that further custody of the petitioner is not required for the purpose of investigation. Hence, this Court is inclined to grant bail to the petitioner, subject to certain conditions.
¶7Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each, for a like sum to the satisfaction of the learned Judicial Magistrate-II, Erode, Erode District and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019'].
