Judgment

ORDER The petitioner apprehends arrest for the alleged offences under Section 309(4) of BNS in Crime No.54 of 2026 on the file of the respondent police seeks anticipatory bail.

¶2The case of the prosecution is that the petitioner along with other accused robbed the de facto complainant's Vivo V17 mobile phone, ₹600 in cash, and a motorcycle along with perfume products worth approximately ₹2,000. Hence the complaint.

¶3The learned counsel for the petitioner submitted that the petitioner is innocent and a false case has been foisted against the petitioner and that he has not committed any offence as alleged by the prosecution. It was further submitted that this is the petitioner's second anticipatory bail application, and he is ready to cooperate with the investigation and abide by any stringent conditions imposed by this Court. Hence, he prayed for the grant of anticipatory bail Hence, he prayed to grant anticipatory bail to the petitioner.

¶4Per contra, the learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the Page3 of 5 petitioner has one previous case and has been regularly committing similar nature of offences. Hence, he opposed to grant anticipatory bail to the petitioner.

¶5I have given my anxious consideration to either side submissions.

¶6It is seen that the petitioner has one previous antecedent for the offence of attempt to murder (under Section 109 of the BNS), while the present case involves an offence of robbery. Further, from the submissions made by the learned Government Advocate (Criminal Side), it is pellucid that the petitioner has misused the liberty granted by this Court on an earlier occasion. Considering the fact this is the case of robbery, if the petitioner is enlarged on bail, while he is having the previous criminal record, it would shocks the conscience of the society.

¶7In view of the above, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 13-07-2026 Index: Yes/No Speaking/Non-speaking order MFA Page4 of 5 To
