Judgment

ORDER The petitioner, who was arrested and remanded to judicial custody on

20.05.2026 for the alleged offence under Section 8(c), 22(b), 29(1) of NDPS Page2 of 4 Act 1985 in Crime No.111 of 2026 on the file of the respondent police, seeks bail.

¶2The case of the prosecution is that the accused persons were found in possession of 60 Nitravet tablets. Hence, this case.

¶3The learned counsel for the petitioner submitted that there are about four accused and this petitioner is arrayed as A2. Though there is total recovery of 60 nitravet tablets, the recovery from this petitioner is only 15 nitravet tablet, which comes under intermediate quantity and the petitioner has been incarcerated since 20.05.2026. Hence, he prays for grant of bail to the Petitioner.

¶4Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and submitted that the petitioner has got seven previous cases, out of which, one case is under murder case. He further submitted that even after the petitioner was enlarged on bail, he has been involved in similar offences. Hence, he opposed the grant of bail to the Petitioner.

¶5I have given my anxious consideration to either side submissions and perused the materials available on record. Page3 of 4

¶6From the submissions made by the learned Government Advocate (Crl.Side), it is seen that the petitioner has got 7 previous cases, which clearly demonstrates that whenever he was granted bail by the Court, he has misused the liberty granted to him. In view of the same, if the petitioner is enlarged on bail, he may be emboldened to indulge in similar offences in future without fear of law. Hence, taking into consideration of interest of the society at large, this Court is not inclined to enlarge the petitioner on bail.

¶7Accordingly, this Criminal Original Petition is dismissed. 09-07-2026 DRL To
