Judgment
ORDER The petitioner, who was arrested and remanded to judicial custody on
16.05.2026 for the alleged offences under Sections 194 of BNSS @ Section 108 of the Bharatiya Nyaya Sanhita, 2023, in Crime No.168 of 2026 on the file of the respondent police, seeks bail.
¶2It is the case of the prosecution that a matrimonial dispute existed between the petitioner and the deceased. It is alleged that, on the date of occurrence, the petitioner, who is the husband of the deceased, abetted her suicide by instigating her to stab herself on the neck with a pair of scissors. Thereafter, the defacto complainant, who is the mother of the deceased, lodged the present complaint. Hence, the case.
¶3The learned counsel appearing for the petitioner would submit that the petitioner is innocent and has been falsely implicated in this case. He would further submit that the petitioner has been in custody since 16.05.2026 and that, in any event, his further custody is not required for the purpose of investigation. Hence, he prayed for the grant of bail.
¶4The learned Government Advocate (Crl. Side) appearing for the respondent police, while opposing the grant of bail, reiterated the prosecution case and, on instructions, submitted that, though the case has been registered for the offence of abetment of suicide, the post-mortem report reveals that the deceased had sustained as many as 19 injuries, out of which three stab injuries and five punctured wounds. He further submitted that the investigation is still pending and that the final medical opinion is yet to be received. It was further submitted that, if the petitioner is enlarged on bail, there is every possibility of his tampering with witnesses.
¶5Considering the submission of the learned Government Advocate (Crl. Side) that, though the case has been registered for the offence of abetment of suicide, the deceased had sustained as many as 19 injuries and the final medical opinion is yet to be received, coupled with the fact that the investigation is still pending, and having regard to the nature of the allegations, this Court is of the view that it would not be appropriate to grant bail to the petitioner at this stage.
¶6Accordingly, the Criminal Original Petition is dismissed.
