ORDER The Writ petition is filed for the following relief: " To issue a writ of certiorarified mandamus to call for the records of the 3rd respondent vide PO4/10432952/4/PPO No.R0432952/POL dated 18.09.2023 and quashing the same as null and void and consequently direct the respondents to re-fix the last drawn salary of the petitioner at Rs.62,700"
¶2The petitioner was appointed as a Grade II Police Constable in the Tamil Nadu Police Department on 23.12.1985 and was subsequently promoted to the post of Grade I P.C., then as Head Constable and then as Sub-Inspector. Page2 of 5 He had voluntarily retired from service on 31.07.2023, while serving as a Sub-Inspector of Police in Dharmapuri District.
¶3The grievance of the petitioner is that after retirement, 3rd respondent passed an impunged pension payment order dated 18.09.2023, wherein his pension was calculated by taking his basic pay of Rs.60900/- instead of Rs,62700/-. Therefore, the petitioner had sent several representations to the respondents seeking refixation of his pension, but no response has been received. Aggrieved by the same, the petitioner has approached this Court.
¶4Heard the learned counsel appearing on both sides.
¶5On perusal of the records, i.e., the payslip of the petitioner for the month of July 2023, it is seen that the petitioner's basic pay is shown as Rs.62,700/-. However, in the impugned pension payment order, his basic pay has been wrongly taken as Rs.60,900/- instead of Rs.62,700/- . Page3 of 5
¶6In view of the fact that the petitioner's last drawn basic pay is Rs.62,700/-, the impugned order passed by the 3rd respondent is set aside. The 3rd respondent shall consider the petitioner's representation seeking re-fixation of his pension on the basis of the correct basic pay and pass appropriate orders in accordance with law within a period of two(2) months, after affording a reasonable opportunity to putforth his case. No costs. Consequently, connected miscellaneous petition is closed. 02-06-2026 Index: Yes/No Speaking/Non-speaking order Mrp To
