Judgment

ORDER [made by M. SUNDAR, J.) Captioned main 'writ petition' {hereinafter 'WP' for the sake of brevity} is predicated on 'representation dated 02.09.2024 sent by the writ petitioner to R1 (District Collector)' {hereinafter 'said representation' for the sake of convenience and clarity} and the matter pertains to 'Survey Nos.33 and 34 in 23 Bagalur Village, Hosur Taluk, Krishnagiri District' {hereinafter 'said land' for the sake of convenience and clarity}.

¶2Mr. T. Ananthasekar, learned counsel on record for writ petitioner, submits that there is inaction qua said representation and that has necessitated the captioned WP.

¶3Issue notice to the respondents. Page Nos.2/6

¶4Mr. T.K. Saravanan, learned Additional Government Pleader, accepts notice for all three respondents and submits that a Peace Committee Meeting was held on 23.08.2012 and it was decided in the meeting that the parties should resolve the disputes by approaching Civil Court. It was submitted by learned State counsel that K. Sathyanarayana, son of Krishnappa, who is the deponent of writ affidavit also attended the Peace Committee Meeting.

¶5However, learned counsel for writ petitioner, adverting to paragraph 7 of the writ affidavit, submitted that the Peace Committee Meeting, no doubt, was held on 23.08.2012 but the conclusion arrived at therein is different.

¶6Today, learned counsel for writ petitioner has been favoured with a copy of the proceedings of the Peace Committee Meeting held on 23.08.2012.

¶7Now that the writ petitioner has been favoured with a copy of the proceedings of the Peace Committee Meeting held on

23.08.2012, it is open to the writ petitioner to work out remedies Page Nos.3/6 available in law qua Peace Committee Meeting. We make it clear that the rights and contentions of other parties to the Peace Committee Meeting as well as any other person who may be concerned with the said land will also stand preserved when remedies are worked out. In other words, all questions are left open.

¶8Ideally, other parties to the Peace Committee should have been made parties to the captioned WP but as the same has not been done, we deem it appropriate to preserve all the rights and contentions of other parties to the Peace Committee and all others concerned in the aforesaid matter so as to give a closure to the captioned WP. Captioned WP stands disposed of as closed in the aforesaid manner albeit with preservation of rights in the aforesaid manner. There shall be no order as to costs. (M.S., J.) (K.G.T., J.)
