ORDER (ORAL)

¶1The short grievance projected by the petitioner in the instant petition is that upon death of her husband, who was working as CT-GD in CRPF under Belt No. 041602627 CT/GD and died-in-harness on 30.07.2015, the petitioner applied to the respondents for appointment on compassionate grounds being her legally wedded wife as also owing to her academic qualifications being possessed of Sanitary Inspector's Diploma as also one year Diploma in Computer Applications, the respondents did not appoint the petitioner on compassionate grounds, thus compelling the petitioner to maintain the instant petition. Serial No. 64

¶2Reply to the instant petition has been filed by the respondents, wherein it is being, inter alia, admitted that the husband of the petitioner was working in CRPF and died on 30.07.2015 in a vehicular accident, whereafter an application came to be received from the petitioner for her appointment on compassionate grounds against the post of HC/Min, whereupon the case of the petitioner was processed and forwarded to the competent authority, however, in the meantime, the petitioner filed WP(C) No. 610/2021 before this Court, which came to be disposed of on 09.12.2021 with a direction to the respondents to consider the case of the petitioner for compassionate appointment and to pass a speaking order thereof and that in compliance whereof, the case of the petitioner was again processed and the competent authority accorded approval in this regard, subject to fulfilment of the eligibility criteria provided in the DOP & T's guidelines and SO-02/2021 and that in furtherance whereof, the petitioner was subjected to various tests, in which she failed in three attempts, whereafter the petitioner again filed the instant petition before this Court for seeking a direction upon the respondents for her appointment on compassionate grounds and that petitioner has been consistently seeking her appointment on compassionate grounds against the posts, which are not available in the rank of CT-GD (male/female), however it is stated that the petitioner can apply for her appointment on compassionate grounds for any other post, a list of available vacancies whereof was

furnished to the petitioner, subject to her being possessed of the eligibility.

¶3Having regard to the aforesaid respective pleading of the parties, it is deemed appropriate to dispose of the instant petition with consent of the appearing counsel for the parties at this stage with a direction to the respondents to consider the case of the petitioner for compassionate appointment against a post for which the petitioner is eligible and entitled thereto in accordance with rules. The aforesaid exercise be undertaken and concluded within a period of three months from the date a copy of this order be provided by the petitioner to the respondents.
