¶1Petitioner/defendant has assailed order dated 11.08.2025 of the learned trial court, whereby in the tenancy suit, application of the plaintiff (respondent herein) under Order XVA CPC was allowed as the petitioner/defendant does not dispute ownership of the respondent/plaintiff over the subject property.

¶2After addressing partly, learned counsel for petitioner/defendant seeks permission to withdraw this petition unconditionally on instructions of his client. Further, on instructions of petitioner/defendant, learned counsel undertakes that the petitioner/defendant shall vacate the subject property within one month from today. It is made clear that mere undertaking of the petitioner/defendant to vacate the subject property within one month shall not be read as any direction to the respondent/plaintiff not to claim the outstanding use and occupation charges in accordance with law.
