¶1This is an application filed by the petitioner under Order Xxlll Rule 1(3)(b) CpC seeking leave of this court to withdraw present petition with libertY to file a civil suit.

¶2Notice. Mr. Navin Chawla, Advocate, accepts notice on behalf of the respondent and submits that he has no objection if the present application is allowed subject to condition that the respondent be allowed to raise such objections, which may be available to the respondent in law.

¶3Accordingly, present application is allowed. Petition stands dismissed as withdrawn. Liberty, as prayed by both the parties, is granted.
