¶1The petitioner seeks initiation of contempt against the respondent for alleged wilful disobedience of the direction of this Court contained in order dated 25.04.2024 passed in W.P (C) No. 5832/2024.
¶2This Court while disposing of the writ petition, observed that there was no confusion over the fact that Mr. Mohd. Yasin had died due to Covid-19, the writ petition was allowed and GNCTD was directed to pass orders granting ex-gratia compensation to the petitioners in accordance with law within six weeks from the date of the aforesaid order.
¶3It is submitted by learned counsel for petitioner that, till date, nothing has been done and, therefore, it is apparent case of wilful disobedience.
¶4Learned Additional Standing Counsel, on instructions, submits that the file is under process and as per the minutes, in light of the above said directions, the Group of Ministers (GOP) has unanimously recommended the This is a digitally signed order. CONT.CAS(C) 1302/2024 2
case for grant of ex-gratia amount of Rs. 1,00,00,000/- to the family members of the deceased in prescribed ratio. It is also stated that such amount would be duly credited in the bank accounts of the eligible family members within six weeks from today.
¶5It is undertaken that a copy of relevant minutes shall be supplied to the learned counsel for the petitioner during the course of day.
¶6Learned counsel for petitioner, has however, stated that though the component of interest on delayed compensation should be assumed to be inbuilt one, in order to have necessary clarification in this regard, he would move appropriate application in the above said writ petition seeking requisite direction and clarification with respect to the disbursal of interest on delayed compensation.
¶7Learned counsel for petitioner would be at liberty to do the same.
¶8However, at the same time, learned counsel for the petitioner, on instruction, states that in view of the above said statement made by learned Additional Standing Counsel, he does not press for initiation of any kind of contempt, as of now.
¶9The petition stands disposed of as not pressed.
