¶6Briefly stated, the present FIR arises out of a road traffic accident which occurred on the night intervening 15/16.08.2016 at Ber Sarai Flyover, Vasant Vihar, Delhi, resulting in the death of Bharat @ Dashrath. On receipt of a PCR call, the police reached the spot and, upon inspection and on the basis of the material recovered from the site and the MLC of the deceased, registered FIR No. 827/2016 under Sections 279 and 304A IPC against the petitioner. After completion of investigation, a chargesheet was filed and the criminal case is presently pending before the learned Trial Court. In the meantime, the legal heirs of the deceased, Respondent Nos. 2 and 3, had settled their compensation claim before the Motor Accident Claims Tribunal. Subsequently, during the pendency of the criminal proceedings, the parties entered into a settlement dated 23.07.2026, whereby the petitioner agreed to pay a sum of ₹10,00,000/- to Respondent Nos. 2 and 3 towards full and final settlement of all claims and disputes arising out of the FIR.
¶7Today, the complainant, who is present in Court, states that he has received the whole amount of ₹10,00,000/- (Rupees Ten Lakhs Only) vide Four Demand Draft Nos. 328551, 000046, 327332, 717094 and has no objection if the present FIR and all consequential proceedings are quashed.
¶8On a query made by this Court, Respondent No. 2 and 3, who have been duly identified by the IO, categorically state that they have entered into the settlement out of their own free will, without any force, coercion or undue influence and have no objection if the present FIR and all proceedings emanating therefrom are quashed. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
¶9In view of the fact that the parties have amicably resolved all their disputes, the entire settlement amount has been paid, and Respondents have no objection to the quashing of the FIR, no useful purpose would be served in continuing the criminal proceedings. There is no legal impediment to quashing the FIR in the facts and circumstances of the present case.
¶10Accordingly, FIR No. 827/2016 , registered at Police Station Vasant Vihar, Delhi, for the offences punishable under Sections 279 and 304A of IPC, and all consequential proceedings emanating therefrom, are hereby quashed.
¶11The present petition, along with pending application(s), if any, stands disposed of.
