Order On Board
16.10.2026 1) The applicant has preferred this First Bail Application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, he has been arrested in connection with Crime No.103/2026 registered at Police Station Telibandha, District Raipur (C.G.) for the offence under Section 318(4), 3(5), 111 of BNS. 2) As per the prosecution case, two fictitious persons, namely Harshit and Rakshit, contacted Hardeep Singh Hora for booking hotels in America and London and demanded foreign currency. On 02.03.2026, at about 2:00 p.m., the complainant went to Currency Tower, Telibandha, Raipur, carrying USD 18,000 and GBP 2,000, and handed over the currency to a person who introduced himself as Rakshit Agrawal. The said person thereafter fled from the spot, following which the complainant lodged an FIR. During the investigation, the police initially arrested Prasannjeet and, on the basis of his memorandum statement, arrested co-accused Mayank. Subsequently, on the basis of memorandum statement of Mayank, the present applicant was taken into custody. Hence the bail application. 3) Learned counsel for the applicant submits that no recovery has been made from the applicant and there is no oral or documentary evidence against him in the charge-sheet. He further submits that no Test Identification Parade was conducted to identify the applicant. He also submits that the applicant has no criminal antecedents, he is in jail since 28.03.2026, and the charge-sheet has already been filed. Therefore, he prays for grant of bail to the applicant. 4) On the other hand, learned State counsel would oppose the bail application and submit that the present applicant is the person to whom the complainant, Hardeep Singh Hora, handed over the foreign currency. He would further submit that the applicant, along with the other co-accused persons, is involved in the commission of the offence. Therefore, he prays for rejection of the bail application. 5) I have heard learned counsel appearing for the parties and perused the case diary. 6) Taking into consideration the fact that no Test Identification Parade was conducted; the applicant has been implicated in the case on the basis of the memorandum statement of co-accused Mayank; the charge-sheet has been filed before the competent Court; the applicant is in jail since 28.03.2026; he has no criminal antecedents; and the conclusion of the trial may take some more time, without commenting on the merits of the case, this Court is of the view that the applicant is entitled to be released on bail. Accordingly, the bail application is allowed. 7) It is directed that in the event of the applicant executing a personal bond for a sum of Rs.50,000/-with one surety in the like sum to the satisfaction of the concerned trial Court, he shall be released on bail on the following conditions:-
(i) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court;
(ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, &
(iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. The observation made hereinabove is for the purpose of deciding this bail application only, the learned trial Court shall decide the case on its own merits. Sd/- (Rakesh Mohan Pandey) JUDGE Rekha
