THIS PETITION COMING ON FOR ORDERS THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE S VISHWAJITH SHETTY

ORAL ORDER Accused No.1 in S.C.No.5096/2025 pending before the Court of III Addl. District and Sessions Judge at Bangaluru Rural, sitting at Anekal, arising out of Crime No.245/2025 registered by Anekal Police Station, Bengaluru Rural district, for the offence punishable under Section 103 (1) of Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as BNS, 2023'), is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail.

¶2Heard the learned counsel for the parties.

¶3FIR in Crime No.245/2025 was registered by the Anekal Police Station, Bengaluru Rural district, for the aforesaid offence was registered against the petitioner herein, based on the first information dated 12.08.2025

received from Tippeswamy B., Police Officer, Anekal police station.

¶4During the course of the investigation of the said case, petitioner herein was arrested on 12.08.2025 and was remanded to judicial custody. After completion of the investigation, charge sheet is filed against him for the aforesaid offence. His bail application filed before the Trial court in SC.No.5096/2025 was rejected on 25.04.2026, therefore he is before this court.

¶5Perusal of the material on record would go to show that the petitioner and the deceased Suresh Kumar hail from Bihar State and they were relatives. They were staying in a rented premises and working as masons. It appears that they were in the habit of consuming alcohol regularly in their room and used to indulge in fighting against each other. On 03.8.2025 also they had consumed alcohol in their room and at about 7.15 p.m., they were found fighting against each other. It appears that

subsequently, petitioner and Suresh Kumar had once again fought against each other and since Suresh Kumar allegedly abused petitioner using filthy language, the petitioner who got enraged assaulted him with his hands and also with the wooden chapathi roller. As a result, Suresh Kumar who had sustained grievous injuries, succumbed to the same.

¶6On the next date, based on the first information, received from the owner of the premises, in which petitioner and Suresh Kumar were staying, UDR case was registered. Subsequently in the post mortem report of deceased Suresh Kumar, it was mentioned that the death was due to shock and hemorrhage as a result of blunt force injuries sustained to chest and abdomen. It is under the circumstances, FIR came to be registered in crime No.245/2025 for offence punishable under section 103 (1) of BNS 2023, based on the first information received from police officer attached to Anekal Police Station, Bengaluru Rural District.

¶7The entire case of the prosecution is based on the circumstantial evidence. Petitioner who has no other criminal antecedent is in the custody for more than one year. Trial in the case is yet to commence. Petitioner and Suresh Kumar who had consumed alcohol together had fought against each other on petty issue and since Suresh Kumar abused the petitioner in filthy language, it appears that petitioner who got enraged, assaulted him with his hands and wooden chapathi roller. The medical officer who has issued final opinion pursuant to the post mortem report, has stated that the deceased who had received blunt force injuries to his chest and abdomen had consumed alcohol prior to death.

¶8In view of the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following:

O R D E R

The Criminal Petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.5096/2025 pending before the court of III Addl.
