THIS W.P. IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO QUASH THE IMPUGNED COMMUNICATION / ORDER PASSED BY THE R3 DATED 15.02.2026 FILE NO.BN1066096601325 VIDE ANNEXURE-J AND FURTHER DIRECT THE RESPONDENTS AUTHORITIES TO ISSUE PASSPORT IN FAVOUR OF PETITIONER.

THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ

ORAL ORDER

¶1The petitioner is before this Court seeking for the following reliefs: a) Please to Issue Writ of Certiorari or any other Writ or Order quashing the Impugned Communication/Order passed by the 3rd Respondent, dated

15.02.2026 File No.BN1066096601325 vide Annexure-J and further direct the Respondents Authorities to issue passport in favour of Petitioner in the interest of Justice and Equity.

b) Allow this Writ Petition with cost and grant such other relief as this Hon'ble Court may deem fit under the facts and circumstances and equity of the case.

¶2The petitioner having made an application for issuance of passport, there being a discrepancy in the spelling of the name of the petitioner, respondent Nos. 2 and 3 had called upon the petitioner to provide adequate documents. An affidavit having been filed explaining the

spelling issue, the same not having been accepted, respondent No.1 vide order dated 15.02.2026 closed the said application. It is challenging the said closure that the petitioner is before this Court.

¶3The issue as regards the name of the petitioner arises out of the discrepancy / spelling error in Special Case No. 536/2016 which came to be disposed of on 18.12.2024 by the III Additional District and Sessions Judge at Tumakuru, wherein his name is spelt as 'Sathish S/o. Late Shanakarappa', whereas in the application which has been filed for issuance of passport, the name is spelt as 'Satheesh Kumar Kachenahalli Shankarappa'. It is this aspect which is sought for being explained by the respondent - Authorities, which the petitioner has not done as of now. It is also pointed out that the name of the father of the petitioner has also been spelt wrongly in Special Case No. 536/2016.

¶4It is for the petitioner to have made necessary application in Special Case No. 536/2016 for correction of the name

and provide a copy of the said order indicating that he has been acquitted. Hence, there cannot be any infirmity found in the order passed by the respondent. Reserving liberty to the petitioner to file suitable application, get the discrepancy in the spelling of the name of the petitioner as well as the name of the father of the petitioner, rectified and furnish a copy of the said order to the respondents along with a fresh application for issuance of passport. If the needful is done, respondents are directed to consider the application and process same as per the applicable law, within 15 days of the receipt of the necessary documents.

¶5With the above observations, the writ petition stands disposed of.
