THIS PETITION, COMING ON FOR PRELIMINARY HARAING IN 'B' GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE H.T. NARENDRA PRASAD

ORAL ORDER This writ petition is filed under Articles 226 & 227 of the Constitution of India, seeking the following reliefs: "i) Issue a writ of mandamus directing the 2nd respondent to consider the case of the petitioner for regularization of her service as a teacher in mathematics in Kithuru Rani Chennamma Residential School, Harimagadi of Soraba Taluk in Shimogga District, or in any other school run and managed by the 2nd respondent within a specified period.

ii) Issue a writ of mandamus directing the 2nd respondent to comply the direction dated

17.07.2013 issued by this Hon'ble Court in W.P.Nos.22459-22475/2013 (Annexure-C) within a specified period.

iii) Issue a writ of mandamus directing the 2nd respondent to give weightage to the service rendered by the petitioner as per the order dated

19.07.2023 passed by this Hon'ble Court in W.A.No.360/2020 (Annexure-G)."

¶2The petitioner was appointed as a Mathematics Teacher in Kitturu Rani Chennamma Residential School, Hiremagadi, Soraba Taluk, Shivamogga District, on

18.01.2010 and served in the said capacity till the academic year 2011–12.

¶3It is the case of the petitioner that thereafter, the Government issued a notification for appointment of teachers to vacant posts. The petitioner along with other similarly situated persons approached this Court by filing W.P. Nos.35501–35509/2012. This Court, by order dated

04.10.2012, disposed of the said writ petitions directing the second respondent to consider the cases of the petitioners who were working on a temporary basis.

¶4Subsequently, the petitioner and other teachers filed W.P.Nos.22459–22475/2013, wherein this Court, by order dated 17.07.2013, directed the respondent No.2 to consider the cases of the petitioners for appointment by

extending service weightage on the basis of the service rendered by them as contract teachers.

¶5Pursuant to the said direction, the petitioners submitted applications seeking appointment to the post of teachers. However, the respondent has not extended the benefit of service weightage. Therefore, the petitioner submitted a representation seeking redressal of the grievance, vide Annexure-D. Since the said representation has not been considered, the petitioner is before this Court.

¶6The learned counsel appearing for respondent No.2 submits that, if this Court grants reasonable time, the representation dated 16.09.2013, submitted by the petitioner vide Annexure-D, will be considered in accordance with law.

¶7In view of the above submission, without expressing any opinion on the merits of the case, this writ petition is disposed of with a direction to respondent No.2

to consider the representation submitted by the petitioner vide Annexure-D, in accordance with law, as expeditiously as possible, and in any event not later than three months from the date of receipt of a certified copy of this order.
