THIS PETITION COMING ON FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE E.S. INDIRESH
ORAL ORDER
In this petition, the petitioner is seeking direction to respondents 2 to 4 to consider the representations dated 26th December, 2025 (Annexures 'E' and 'F') and to issue original Marks Cards of all six semesters of Bachelor of Performing Arts including the Bachelor Degree Certificate by mentioning correct class and upload the same in the Digi Locker along with the proper Gold Medal Certificate by the competent person in respect of the petitioner.
¶2Heard Sri. Somashekaraiah R.P., learned counsel appearing for the petitioner; Smt. Sukanya Baliga B., learned
Additional Government Advocate appearing for the respondent No.1; and Sri. Rajendra Kumar Sungay, learned counsel appearing for respondents 2 and 3.
¶3The relevant facts for adjudication of this petition are that the petitioner herein has admitted in the respondent No.4-College for three years course in Bachelor of Performing Arts (BPA) during the Academic year 2022-23. The petitioner successfully completed the aforesaid course and as such, Convocation Certificate was issued in 106th Annual Convocation on 05th January, 2026 as per Annexure-K. It is also stated in the petition that the petitioner was also issued with a Gold Medal by the respondent-University.
¶4The grievance of the petitioner is that the respondents have not issued the original Marks Cards of all the six semesters of the course. It is also the grievance of the petitioner that, though the petitioner is awarded with the gold medal, however, in the Convocation Certificate issued by the respondent-University, the Class/Grade obtained by the petitioner is mentioned as Pass Class. Therefore, the petitioner sought for interference of this Court.
¶5Heard Sri. Somashekaraiah R.P., learned counsel appearing for the petitioner; Smt. Sukanya Baliga B., learned Additional Government Advocate appearing for the respondent No.1; and Sri. Rajendra Kumar Sungay, learned counsel appearing for respondents 2 and 3.
¶6Sri. Somashekaraiah R.P., learned counsel appearing for the petitioner submits that the petitioner has successfully completed three years course of Bachelor of Performing Arts (BPA) and she was awarded with a gold medal, however, the respondent-University had not issued the original Marks cards to the petitioner. Learned counsel further submits that, though the petitioner is awarded with gold medal in the aforesaid course, the respondent-University in a Convocation Certificate issued to the petitioner, mentioned the Class/Grade obtained by the petitioner as Pass Class. Accordingly, he sought for interference of this Court for proper direction to the respondents.
¶7Per contra, Sri. Rajendra Sungay, learned counsel appearing for respondent-University, by referring to the averments made in the statement of objections, invited the
attention of the Court to order dated 16th February, 2026 (Annexure-R1), wherein, the respondent-University has taken decision to change the name of the course Bachelor of Performing Arts (BPA) as Bachelor of Arts (Fine Arts) and submitted that the matter is pending consideration before the respondent-State. He further submitted that, the respondent-University addressed Letters dated 25th November, 2024; 05th April, 2025; 20th November, 2025; and 16th March, 2026 (Annexures-R2 series) to the respondent No.1-State in respect of the grievance of the petitioner. Accordingly, he sought for direction to the respondent No.1-State to take decision in the matter.
¶8Smt. Sukanya Baliga B., learned Additional Government Advocate appearing for the respondent No.1 sought to justify the action of the respondent No.1-State.
¶9In the light of submission made by learned counsel appearing for the parties, it is not in dispute that the petitioner got admitted for three years course of Bachelor of Performing Arts (BPA) in the respondent-University for the Academic year 2022-23 and she completed the course during the year 2024-
¶25Perusal of Annexure-D issued by the respondent-University, the same would indicate that the petitioner was awarded with Gold Medal in Bachelor of Performing Arts. In this regard, Convocation Certificate is also issued and same is produced at Annexure-K, however, in the said certificate the Class/Grade obtained by the petitioner is shown as Pass Class though the petitioner is a meritorious and awarded with Gold Medal.
¶10In that view of the matter, the respondent No.1-State and respondents 2 and 3 are directed to take steps as to issue original Marks Cards of all six semesters and proper Gold Medal Certificate by the competent person to the petitioner in Bachelor of Performing Arts, so also, to upload the same in Digi Locker within a period of four weeks from the date of receipt of this order. Accordingly, writ petition is disposed of.
