THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE R DEVDAS
ORAL ORDER Learned High Court Government Pleader takes notice for all the respondents.
¶2It is the contention of the petitioner that pursuant to the application filed by the petitioner, in the
year 1972, an official memorandum was issued by the Tahsildar, Maddur Taluk, on 18.08.1972, granting 20 guntas of land in Survey No.49 of K. Bellur Village, Kasaba Hobli, Maddur Taluk Mandya District. At Annexure-F is the intimation letter issued by the Tahsildar to the petitioner to pay the kimmat of Rs.1,000/-. At Annexure-G is the saguvali chit issued in favour of the petitioner. Learned counsel submits that all these documents have been and therefore the Tahsildar cannot deny the said documents furnished by the petitioner and the claim of the petitioner itself. However, the Tahsildar has not considered the representation at Annexure-J given by the petitioner on 27.03.2025 to enter the name of the petitioner in the revenue records. Therefore, the prayer in the petition is to issue necessary directions to the Tahsildar to enter the name of the petitioner in the revenue records.
¶3Having regard to the prayer made in the writ petition and submissions of the learned Counsel for the
petitioner, this Court is of the considered opinion that the 3rd respondent-Tahsildar, Maddur Taluk, is duty bound to consider the representation given by the petitioner and pass necessary orders for entering the name of the petitioner in the land revenue records. Needless to observe that the Tahsildar shall verify the original Grant Register, the Saguvali Chit Issue Register, and other contemporaneous records to find out about the genuineness of the grant made in favour of the petitioner. If it is found that the grant was made in favour of the petitioner, then the Tahsildar shall proceed to enter the name of the petitioner in the land revenue records in accordance with law. The entire exercise shall be completed as expeditiously as possible and at any rate within a period of two months from the date of receipt of a copy of this order. With these observations, the writ petition stands disposed of.
¶4Needless to observe that till a final decision is taken by the Tahsildar, no precipitative action shall be taken to dispossess the petitioner from the lands in question.
¶5Learned High Court Government Pleader is permitted to file memo of appearance within a period of four weeks from today.
