THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE R DEVDAS
ORAL ORDER
Learned Additional Government Advocate takes notice for both the respondents.
¶2It is the contention of the petitioner that he has filed an application in Form No.3A on 07.12.2015 seeking regularisation of unauthorised occupation of a dwelling house measuring 2400 square feet situated in Survey No.60 situated at Bommasandra village, Attibele Hobli, Anekal Taluk, Bangalore urban district. However, till date the application has not been considered and no orders are passed. Therefore, the prayer in this writ petition is to direct the respondents-authorities to consider the application filed by the petitioner.
¶3Learned Counsel for the petitioner has drawn the attention of this Court to the Annexures filed along with memorandum of writ petition and contends that consequent to the application filed by the petitioner, his statement has been recorded by the Revenue Inspector and the Revenue Inspector has submitted his report to the Tahsildar along with Mahazar. Nevertheless, no further action has been taken.
¶4Learned Counsel for the petitioner further submits that provisions in Section 94C of the Karnataka Land Revenue Act, 1964, enables the prescribed authority who, on satisfaction, after conducting an enquiry, deems it fit that any person who is in unauthorized occupation of any land belonging to Government and has constructed a dwelling house on such land prior to 01st January, 2015, may on an application made to the prescribed authority grant such lands. In that view of the matter, learned Counsel for the petitioner submits that respondent-
authorities may be directed to reconsider the application filed by the petitioner.
¶5There is substance in the submission made by the learned Counsel for the petitioner.
¶6Having regard to the prayer made in the writ petition and the contentions of the learned Counsel for the petitioner, this Court is of the considered opinion that the primary requirement of the provision is that the applicant should satisfy the prescribed authority that he/she has put up dwelling house on Government lands within the urban agglomeration and if the applicant satisfies all the requirements of law, then appropriate orders will have to be passed by the Tahsildar regularizing the unauthorized occupation.
¶7In that view of the matter, the writ petition stands disposed of with a specific direction to the 2nd respondent-Tahsildar, Anekal Taluk, to consider the application filed by the petitioner and pass necessary orders as expeditiously as possible and at any rate within
a period of 2 months from the date of receipt of a copy of this order.
¶8Learned Additional Government Advocate is permitted to file memo of appearance within a period of four weeks from today.
