SHAMANTH NAIK, HCGP) THIS WP IS FILED UNDER ARTICLE 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO ISSUE WRIT OF MANDAMUS, OR ANY OTHER WRIT OR DIRECTIONS TO THE RESPONDENT NO.2 TO CONSIDER THE APPLICATION FORM NO.53, DATED 10. 12-1998 UNDER LAND REVENUE RULES FOR GRANT THE LAND IN RESPECT OF SY.NO.94 MEASURING 2 ACRE 08 GUNTAS AND ETC., THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE R DEVDAS ORAL ORDER Learned High Court Government Pleader takes notice for all the respondents.
¶2It is the contention of the petitioner that he has filed application in Form No.53 on 10.12.1998 seeking regularisation of unauthorised occupation of an extent of 2.08 acres of land in Survey No.94 of Mugabala Village, Jadigenahalli Hobli, Hoskote Taluk, and the same has not been considered till
date and no order has been passed. Therefore, the prayer in the petition is to direct the respondents to consider the application filed in Form No.53 by the petitioner in the year 1998.
¶3Having regard to the contentions raised in the writ petition and submission of the learned counsel for the petitioner, this Court is of the considered opinion that respondent No.2-Tahsildar was duty bound to place the application filed by the petitioner before the 3rd respondent-Committee and the Committee was also duty bound to consider the application and pass necessary orders.
¶4The writ petition stands disposed of with a specific direction to respondent No.2-Tahsildar, Hoskote Taluk, to verify from the records as to whether such an application filed by the petitioner seeking regularisation of unauthorized occupation of land at Annexure-A dated 10.12.1998 is pending consideration. If it is found that such application was indeed filed by the petitioner and the application is yet to be considered, the Tahsildar is directed to place before the Committee for regularisation of unauthorised occupation, the application along
with his recommendation within a period of two months from the date of receipt of a copy of this order. Thereafter, the Committee shall consider the application and pass necessary orders in accordance with law as expeditiously as possible and at any rate within a period of two months from the date of receipt of a copy of this order. Ordered accordingly.
