THIS WP IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECTING THE 4TH RESPONDENT (TAHSILDAR) TO CONSIDER THE PETITIONER'S REPRESENTATION DATED 28.11.2023 ANNEXURE-A AND RESTORE THE KHATHA AND REVENUE ENTRIES IN RESPECT OF THE LAND BEARING SY. NO. 103 MEASURING 3 ACRES 10 GUNTAS SITUATED AT NELLAQULI VILLAGE, UTTARAHALLI HOBLI, BENGALURU SOUTH TALUK, TO THE NAME OF THE PETITIONER/GRANTEE, REFLECTING THE POSITION AS IT STOOD PRIOR TO THE PASSING OF THE QUASHED ORDER DATED 28.07.2016 AS PER ANNEXURE-E AND ECT.

THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE R DEVDAS

ORAL ORDER Learned High Court Government Pleader takes notice for all the respondents.

¶2Learned counsel for the petitioner submits that when a common order was passed by

Commissioner, Bangalore South Sub-Division in case No.LND.RA(S)16/15-16 dated 28.07.2016, canceling the grants made in favour of the petitioner's father in the year 1991-1992, the petitioner approached this Court in W.P.No.3519/2021. This Court by an order dated 12.07.2021, set aside the order passed by Commissioner insofar as petitioner's father is concerned and remanded the matter back to the Assistant Commissioner for reconsideration after giving due opportunity to the petitioner and the petitioner was also given liberty to urge all grounds in the said proceedings. Learned counsel submits that though the order was passed on

12.07.2021, the Assistant Commissioner has not taken up the matter till date.

¶3Further, petitioner had also filed W.P.No.2956/2026, being aggrieved by the fact that the Assistant Commissioner had not taken up the matter, pursuant to the directions issued by this Court. This Court disposed of the said writ petition on 02.02.2026, directing the Assistant Commissioner to dispose of the proceedings in LND RA

(S)16(75)/2015-16, after hearing the rival parties and to conclude the proceedings within a period of three months.

¶4The prayer in the writ petition is to issue a writ of mandamus directing the respondent-Tahsildar to restore the revenue entries in favour of the petitioner's father.

¶5Learned High Court Government Pleader raises an objection that this Court has already issued directions to the Assistant Commissioner to conclude the proceedings within a period of three months. Therefore, at this stage, the name of the petitioner's father cannot be restored in the revenue records.

¶6Having regard to the facts narrated hereinabove, the writ petition stands disposed of directing the respondent-Tahsildar to await the orders that would be passed by the Commissioner. However, if Commissioner does not pass an order within the time stipulated by this Court in W.P.No.2956/2026, the respondent-Tahsildar shall proceed to enter the name of the petitioner's father in the revenue record. On the other hand, if an order is passed by the

Assistant Commissioner within the time stipulated in the said writ petition, the Tahsildar shall be bound by such an order.
