Order on Board 16/10/2026
¶1By the present writ petition, the petitioner seeks a direction to the respondent authorities to consider and decide his representation seeking grant of annual increments and consequential pay fixation from the date of his initial appointment by passing a reasoned and speaking order within a stipulated period, and to release the consequential monetary benefits and arrears.
¶2Learned counsel appearing for the petitioner submits that, though the petitioner was appointed in the year 2021, the benefit of annual increments has not been granted to him on the ground that he failed to pass the Hindi Computer Skill Examination within three years from the date of his appointment, as stipulated in the appointment order. He submits that the petitioner subsequently passed the said examination in the year 2025. Learned counsel further contends that similar issue has come up for consideration and decided by this Court in the matter of Jaiprakash Bhuneshwar & Ors. vs. State of Chhattisgarh & Ors. (WPS No. 12525/2025 decided on 06.10.2026). He would also submit that the petitioner had submitted a representation before the Collector, Jashpur, seeking grant of the benefit of annual increments, He, therefore, prays that the present petition may be disposed of with a direction to the Collector, Jashpur, to consider and decide the petitioner's representation dated 01.09.2026 in accordance with law.
¶3On the other hand, learned State counsel submits that if the petitioner's representation is still pending consideration, the same shall be considered and decided in accordance with law within the stipulated period.
¶4I have heard learned counsel for the parties and perused the material available on record.
¶5Considering the limited prayer made by learned counsel for the petitioner and taking into account the submission made by learned State counsel, this writ petition is disposed of with a direction to the respondent authorities and the Collector, Jashpur, to consider and decide the pending representation dated 01.09.2026 (Annexure P/4) submitted by the petitioner, strictly in accordance with law, and pass a reasoned and speaking order, preferably within a period of 60 days from the date of receipt of a copy of this order.
¶6With the aforesaid direction, the writ petition stands disposed of. Sd/-
