2.

On 02.12.2022, the following order was passed:-

" Petitioners are seeking anticipatory bail in case bearing FIR No. 180 dated 07.11.2022 under Sections 376(2)(n), 376(3), 506 IPC and Sectoin 6 of Protection of Children from Sexual Offences Act, registered at Police Station Women Bhiwani. Precisely, the allegations against the petitioners are to the effect that they had been repeatedly committing rape upon the victim spreading over a period of 4 years. The petitioners are the uncles of the victim.

Learned counsel for the petitioners contend that there is a delay of 4 years in lodging the FIR. In fact, the victim was in relationship with someone. The mother of the victim wanted to solemnize her marriage elsewhere. The petitioners being relatives had extended help to the mother of the victim in solemnizing her marriage with Hardeep. Consequently, the victim had lodged a false case against the petitioners. It has been further submitted that mother of the victim had sworn an affidavit, Annexure P-1, which indicates false implication of the petitioners. Notice of motion. Mr. Karan Garg, AAG Haryana accepts notice on behalf of the State and seeks time to get instructions. Mr. Jasbir Mor, Advocate has joined proceedings on behalf of the complainant and submits that there was lurking

fear on account of threat in the mind of the victim extended by the petitioners which prevented her from reporting the matter to the Police at the earlier instance. After her marriage, she gained strength with the support of her husband and came forward to report the matter to the Police. Even the affidavit, Annexure P-1 of the mother of the victim is dated 04.11.2022 whereas the FIR has been lodged subsequently on 07.11.2022. Adjourned to 11.04.2023. Meanwhile, the petitioners shall join the investigation and would come present as and when called for and in the event of arrest, the petitioners shall be admitted to interim bail on their furnishing personal and surety bonds to the satisfaction of Arresting/Investigating Officer. The petitioners shall also abide by the conditions as specified under Section 438(2) Cr.P.C."

3.

After observing that there is a delay of 04 years in lodging of FIR and the victim was in relationship with someone, this Court had granted interim bail to the petitioners. After that the case was adjourned and interim order continued.

4.

On 20.03.2023, the following order was passed:- " Reply by way of affidavit dated 18.03.2023 of Virender Singh, H.P.S., Deputy Suprintendent of Police, Bhiwani, filed on behalf of respondent-State is taken on record. Registry is

Learned State counsel submits that Investigating Officer would submit application before competent Court for the aforesaid purpose. Adjourned to 30.05.2023. Interim order to continue."

5.

A perusal of the above-mentioned order shows that it was on the basis of submissions of both the counsels that polygraph test was allowed.

6.

The relevant portion of the reply filed by way of affidavit dated 18.03.2023 of Virender Singh, H.P.S., Deputy Suprintendent of Police, Bhiwani, is reproduced as under:- "5. Both the petitioners were actively involved in the commission of offence. There are ample evidences against the present petitioners and there are sanguine chances of their conviction. 8.

Learned counsel for the complainant submits that since the date the petitioners were granted interim bail i.e. 02.12.2022, the victim and

her family members are being pressurized to withdraw the complaint. He further submits that the victim is receiving fake calls by stating that they are calling from the Jail Superintendent Office and when this was verified from the Jail Superintendent Office, whether any call was made by them, it was found that the said numbers were not of Superintendent's Office. Learned counsel for the complainant has shown to this Court two complaints made by the victim in this regard, which are also taken on record.

9.

Learned counsel for the petitioners has placed reliance on the judgment of Suman Vs. Ram Mehar and Others 2015 (27) R.C.R (Criminal) 867 wherein it has been held that polygraph test is not a substantive evidence and it cannot be used to prove the guilt of the accused. This judgment would be of no help to the petitioner since the polygraph test is conducted in view of order dated 20.03.2023 and the petitioners agreed to the same.

10.

I have heard learned counsel for the parties and perused all the documents placed before this Court i.e. FIR, status report mentioned above, report of polygraph examination, etc.

11.

In view of the discussion made above, this Court does not find any merit in the present petition, which is accordingly dismissed.

12.

Pending applications, if any, also stand disposed off.
