Income-tax Act, 1961 · Chapter IV: Computation of Total Income · D.—Profits and gains of business or profession
Section 32: Depreciation
The Income-tax Act, 1961 was repealed by the Income-tax Act, 2025 from 1 April 2026. The text is kept here because the judgments below apply it.
In plain words
This section allows depreciation on buildings, machinery, plant and furniture, and on intangible assets like patents, copyrights, trade marks and licences acquired on or after 1 April 1998, if the assessee owns them and uses them for business.
- The asset must be owned, wholly or partly, by the assessee and used for business or profession.
- For most assets, depreciation is a prescribed percentage of the written down value of the block of assets.
- Power generating undertakings can claim a prescribed percentage of actual cost instead.
- If an asset is used for less than one hundred and eighty days in the year it is acquired, only fifty per cent of the normal depreciation is allowed for that year.
- Depreciation is allowed even if the assessee does not claim it in some situations, and unabsorbed depreciation can be carried forward.
- Courts have held that goodwill can be a business asset eligible for depreciation as an intangible right.
