Code of Criminal Procedure, 1973 · Chapter XXXVII: Miscellaneous

Section 482: Saving of inherent power of High Court

The Code of Criminal Procedure, 1973 was repealed and replaced by the Bharatiya Nagarik Suraksha Sanhita, 2023 from 1 July 2024. It still applies to matters and proceedings from before that date, as the repealing law provides.

Now in the BNSS section 528 (Saving of inherent powers of High Court)

In plain words

Nothing in this Code limits the High Court's inherent powers to make orders needed to give effect to orders under this Code, to prevent abuse of the process of any court, or otherwise to secure the ends of justice. This is often used to quash proceedings.

A simplified explanation, prepared with AI assistance from the official text below and checked automatically against it for numbers and cross-references. The official text is the law and prevails over this summary. Not legal advice.

Official text

Nothing in this Code shall be deemed to limit or affect the inherent powers of the High Court to make such orders as may be necessary to give effect to any order under this Code, or to prevent abuse of the process of any Court or otherwise to secure the ends of justice.

Corresponding sections were matched by comparing the wording of both official texts, and for the IPC and BNS, also against a published correspondence table. Wording, punishments and structure often changed, so read both sections before relying on the match.

Understanding this section

Section 482 preserves the inherent powers of the High Court to give effect to orders under the Code, to prevent abuse of the process of any court, and otherwise to secure the ends of justice. It is most often invoked to quash FIRs and criminal proceedings. The power is wide but must be used sparingly.

Three purposes

  • To give effect to an order under the Code.
  • To prevent abuse of the process of any court.
  • Otherwise to secure the ends of justice.

The Bhajan Lal categories

The Supreme Court has given illustrative categories where quashing may be justified, including: where the allegations, even taken at face value, do not make out any offence; where they disclose no cognizable offence justifying investigation; where they are so absurd and inherently improbable that no prudent person could accept them; where there is an express legal bar to the proceedings; and where the proceeding is manifestly attended with mala fides or instituted with an ulterior motive. The list is illustrative, not exhaustive.

What the High Court does not do

It does not hold a mini trial or weigh competing evidence. The question is whether the allegations on the face of the FIR or complaint disclose an offence. Interference at the investigation stage is the exception; blanket orders of no coercive steps without reasons are improper.

Quashing on settlement

For offences that are essentially private, such as commercial or matrimonial disputes, the High Court may quash proceedings where the parties have settled, even if the offence is not compoundable. This does not extend to heinous offences or offences against society, such as murder or rape.

Civil disputes given a criminal colour

Where a dispute is essentially civil and criminal proceedings are used to pressure the other side, quashing under section 482 is appropriate.

Key Supreme Court rulings

  • State of Haryana v. Bhajan Lal 1990 INSC 363 : 1992 Supp (1) SCC 335

Laid down illustrative categories of cases in which the extraordinary power under Article 226 or the inherent power under section 482 may be exercised to quash proceedings, while noting it is not possible to lay down an exhaustive list or rigid formula.

  • Neeharika Infrastructure Pvt. Ltd. v. State of Maharashtra 2021 INSC 253

The power of quashing should be exercised sparingly and with circumspection; save in exceptional cases the court should not interfere at the investigation stage, and blanket no coercive steps orders without reasons are impermissible.

  • Gian Singh v. State of Punjab 2012 INSC 419

The High Court may quash criminal proceedings on the basis of a settlement in offences that are predominantly civil or private in character, but not in heinous and serious offences affecting society.

  • Inder Mohan Goswami v. State of Uttaranchal 2007 INSC 1016

Criminal proceedings initiated in a purely civil dispute were an abuse of process and were quashed under section 482.

Common mistakes

  • Asking the High Court to weigh evidence or decide disputed facts under section 482.
  • Seeking quashing on settlement in serious offences against society.
  • Treating the Bhajan Lal categories as exhaustive.
