Code of Criminal Procedure, 1973 · Chapter XXXIII: Provisions As to Bail and Bonds
Section 439: Special powers of High Court or Court of Session regarding bail
The Code of Criminal Procedure, 1973 was repealed and replaced by the Bharatiya Nagarik Suraksha Sanhita, 2023 from 1 July 2024. It still applies to matters and proceedings from before that date, as the repealing law provides.
In plain words
A High Court or Court of Session can release any accused in custody on bail, impose conditions, and set aside or change conditions imposed by a Magistrate. It can also order the arrest of anyone released on bail.
- For offences triable only by a Court of Session or punishable with imprisonment for life, the Public Prosecutor must be given notice unless impracticable for recorded reasons.
- For rape of young girls under sub-section (3) of section 376 and sections 376AB, 376DA and 376DB of the Indian Penal Code, notice must be given within fifteen days, and the informant must be present at the hearing.
