Code of Criminal Procedure, 1973 · Chapter XXVIII: Submission of Death Sentences for Confirmation
Section 366: Sentence of death to be submitted by Court of Session for confirmation
The Code of Criminal Procedure, 1973 was repealed and replaced by the Bharatiya Nagarik Suraksha Sanhita, 2023 from 1 July 2024. It still applies to matters and proceedings from before that date, as the repealing law provides.
In plain words
When a Court of Session passes a death sentence, the proceedings must be sent to the High Court, and the sentence cannot be carried out unless the High Court confirms it. Meanwhile, the convict is committed to jail custody.
