ORDER (ORAL)
¶1Heard Mr. C.C.T. Sangma, learned counsel for the applicants who has submitted that the opposite party No. 3 herein had instituted a suit before the Civil Court being T.S. No. 11 (H) of 2020 for declaration and permanent injunction. The suit was aimed primarily at the petitioner herein as defendant.
¶2In course of proceedings, an order dated 08.10.2020 was passed in
Misc. Case No. 9 (H) of 2020 arising out of the said Title Suit aforementioned by the Trial Court, directing the parties in the suit to maintain status quo.
¶3It is also submitted that during the pendency of the suit, the opposite party No. 1/State of Meghalaya represented by the Secretary, ERTS Department, Government of Meghalaya, Shillong had filed an application under Order 7 Rule 11 of the Code of Civil Procedure for rejection of the plaint. The Trial Court, upon hearing the parties vide order dated 01.04.2021 dismissed the said application.
¶4Being aggrieved by the said order dated 01.04.2021, the opposite party/petitioner herein had preferred the instant civil revision petition being CRP. No. 11 of 2021 before this Court. In course of these proceedings, the applicants herein have now approach this Court, seeking to be impleaded as party respondents in CRP. No. 11 of 2021 on the ground that they were also parties in the said suit. The prayer made was with reference to the fact that when this civil revision petition was preferred before this Court, they have not been arrayed as party respondents. It is therefore prayed that this application may be allowed and necessary orders may be passed.
¶5Mr. A.H. Kharwanlang, learned Addl. Sr. GA appearing on behalf of the opposite parties No. 1 & 2 herein has submitted that there is no objection to the prayer made in this application and this Court may allow the
applicants herein to be impleaded accordingly.
¶6Mr. M.L. Nongpiur, learned counsel appearing on behalf of the opposite party No. 3 herein has also submitted that there is no objection to the prayer made by the applicants. On consideration of the submission made, the prayer of the applicants to be impleaded as party respondents in CRP. No. 11 of 2021 is hereby allowed. In view of the above, MC(CRP) No. 12 of 2023 is disposed of accordingly.
