¶2This Writ Petition is filed to direct the respondents to grant permission, to provide necessary police protection for conducting Vinayagar Chaturthi Festival at Arulmigu Sri Selva Vinayagar Temple, Lala Kudiyiruppu, Pudur, Tenkasi District, and for taking the vinayagar idol in procession on 15.09.2026.
¶3The learned counsel for the petitioner submitted that the petitioner, who is residing at Pudur, Lalakudiyiruppu, South Street, Tenkasi District, is planning to conduct the Vinayagar Chaturthi festival on 15.09.2026. In this regard, he had requested the respondent police to grant permission and provide police protection by his representation dated 13.08.2026. Since the said representation has not been considered so far, the present writ petition has been filed.
¶4The learned State counsel submitted that there is a Government Order in G.O.(Ms.) No.598, Public (Law and Order-B) Department, dated 09.01.2018, prescribing guidelines for the installation and worship of Vinayagar idols and their immersion. As per the said guidelines, persons intending to celebrate Vinayaka Chaturthi are required to submit an application in Form No.I to the designated authority, namely, the Assistant Commissioner of Police or the Revenue Divisional Officer concerned, as the case may be. The applicant is also required to produce the necessary No Objection Certificates (NOCs) from the various Departments. Upon being satisfied with the compliance of the prescribed conditions, the authorities will consider the application and grant permission in Form No.II, as contemplated under the said Government Order. However, the petitioner has not followed the procedure prescribed under the said Government Order. If the petitioner intends to proceed in accordance with the said guidelines, this Court may pass appropriate orders directing the authorities to consider the petitioner's application, if any, submitted in due course.
¶5Recording the above submission, this writ petition is dismissed, granting liberty to the petitioner to work out his remedy by submitting an application in Form No.I, in accordance with G.O. (Ms.) No.598, dated 09.01.2018, henceforth. If the petitioner submits the application along with the necessary documents, the designated authorities are directed to consider the same and pass appropriate orders before the scheduled date of the Vinayagar Chaturthi festival.
¶6With the above observations, this Writ Petition is dismissed.
