Judgment
O R D E R (Order of the Court was made by M.DHANDAPANI, J.) This Writ Petition has been filed for issuance of a Writ of Mandamus directing the respondents 1 to 4 to consider the representations of the Petitioner by way of initiate proceedings under the law to remove the illegal walls, gates, and encroachments erected by the respondents 5 and 6 in the public pathway in T.S. No. 18/1, Ward 5, Block 95, Ponmeni Village, Madurai West Taluk, and restore free public ingress and egress to Plot No. 23.
¶2Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the stage of admission itself.
¶3Since no adverse order is going to be passed, notice to the fifth and sixth respondents is dispensed with.
¶4The petitioner asserts that she purchased the house property bearing Plot No.23, by way of a registered Sale Deed dated 29.04.2024. The public pathway comprised in T.S. No.18/1, Ward 5, Block 95, Ponmeni Village, Madurai West Taluk, which is the sole access pathway leading to the said plot has been obstructed by the respondents 5 and 6 by illegally erecting walls, gates and other encroachments. The petitioner has submitted representation dated
16.07.2026 before the respondents 1 to 4 seeking initiation of appropriate proceedings for removal of the said illegal walls, gates and encroachments and restoration of free public ingress and egress to Plot No.23. Since no effective action has been taken on the said representations, the present Writ Petition has been filed.
¶5The learned counsel appearing for the petitioner would submit that it would suffice if this Court issues a direction to the respondents 1 to 4 to consider the petitioner's representation dated 16.07.2026 and pass appropriate orders thereon, on merits and in accordance with law, within a time frame to be fixed by this Court.
¶6The learned Government Advocate appearing for the official respondents, on instructions, would submit that the authority concerned will consider the petitioner's grievance and pass appropriate orders on merits and in accordance with law.
¶7Considering the above facts and circumstances of the case and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the respondents 1 to 4 to consider the petitioner's representation dated 16.07.2026 and pass appropriate orders on merits and in accordance with law, after issuing notice to all necessary parties including the respondents 5 and 6 and affording them an opportunity of hearing. The entire exercise shall be completed as expeditiously as possible, preferably within a period of twelve weeks from the date of receipt of a copy of this order. No costs. [M.D.I.,J.] & [N.D.K.,J.]
