Judgment
O R D E R [Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] Challenging the order dated 30.07.2026, passed by the first respondent, rejecting the request of the petitioner for grant of 21 days ordinary leave to her husband / convict prisoner, this writ petition has been filed with a consequential direction to the respondents to grant 21 days ordinary leave without escort to her husband.
¶2Learned counsel for the petitioner would submit that the convict prisoner was on bail during trial and during such time, he had not misused the liberty given to him and there was no allegation of threatening or contacting the witnesses. He would further submit that the convict prisoner is ready to abide by any stringent conditions that may be imposed on him.
¶3Learned counsel for State of Tamil Nadu (Criminal Side) appearing for the respondents would submit that since the convict prisoner has been convicted in a POCSO, the respondents granted ordinary leave with escort in terms of the guidelines issued under various Government Orders.
¶4Taking into consideration the grounds on which the ordinary leave is sought for, we are inclined to issue the following directions:
(i) The respondents are directed to grant 21 days ordinary leave, without escort, to the convict prisoner, namely, Selvaprabhu, son of Narayanan (PID No.32358), who is now detained in the Central Prison, Madurai.
(ii) During the leave period, the convict prisoner shall report before the Tallakulam Police Station, Madurai District, daily at 06.30 p.m.
(iii) During the leave period, convict prisoner shall not make any attempt to contact the victim or her relatives.
(iv) During the leave period, the convict prisoner shall abide by all the conditions prescribed in the Jail Manual.
¶5With the above directions, this writ petition is disposed of. No costs.
