Judgment

O R D E R [Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] The petitioner has filed this habeas corpus petition seeking a direction to the respondents to secure his daughter, namely, Shafurul Hazeena, aged about 21 years and 02 months, produce her before this Court and set her at liberty.

¶2Today, when this matter is taken up for hearing, learned counsel for State of Tamil Nadu (Criminal Side) appearing for the respondent – Police, on instructions, submitted that based on the complaint given by the petitioner, an enquiry was conducted and during enquiry, it was found that the missing person is aged about 21 years and 02 months and she has gone out of the house on her own volition and got married to one R.Sulthan Alaudeen, son of Raja Mydeen, aged about 26 years, on 03.08.2026, in Tamilnadu Muslim Dhava Jamath, and they have been produced before this Court. He would further submit that the girl had also given a complaint alleging that she was facing some problem from her parents, based on which enquiry was conducted and it was closed.

¶3When we enquired the missing person, she submitted that she was in love with one R.Sulthan Alaudeen and on her own volition, she had gone out of the house of the petitioner and married to him and produced before this Court the marriage registration certificate issued by the Tamilnadu Muslim Dhava Jamath, to that effect.

¶4In the light of the above, this Court is of the view that the custody of the missing person is not illegal and the habeas corpus petition is, therefore, closed.
